Privacy policy

TIER IV Inc. (Address: Nagoya University Open Innovation Center, 1-3, Mei-eki 1-CHOME, Nakamura-Ward, Nagoya-City, Aichi Prefecture Japan, the "Company") believes it is an important social responsibility to appropriately handle and protect users' personal information collected in the development of software and platform and other business activities incidental thereto. The Company will strive to properly handle and protect any personal information it collects in accordance with this policy on the protection of personal information (the "Policy").

1. Definition of Personal Information and Personal Data

1. Personal Information means information about a living individual that falls under any of the following:

(a) Information that can identify a specific individual by name, date of birth, telephone number, e-mail address or any other similar information;
(b) Information which, although cannot identify a specific individual on its own, can be readily collated with other information and thereby identify a specific individual;
(c) Information containing an individual identification code (as defined in Article 2, Paragraph (2) of the Act on the Protection of Personal Information (the "Personal Information Protection Act")).

2. Personal Data means Personal Information that constitutes a personal information database, etc. (Article 2, Paragraph (4) of the Personal Information Protection Act).

2. Collection and Purposes of Use of Personal Information

1. The Company will collect and use Personal Information through lawful and appropriate means within the scope necessary to achieve the following purposes:

(a) To provide proposals, notices, and other information regarding various services offered by the Company;
(b) To verify the user's identity associated with the services provided by the Company;
(c) For after-sales services, and responding to inquiries and complaints incidental to (a) or (b) above;
(d) To provide Personal Information or Personal Data to third parties in order to achieve the purposes of use above.

2. When it becomes necessary to use the user's Personal Information for any purpose other than those in the preceding paragraph, the Company will inform the user of the purpose and obtain consent in advance before such use, except in any of the following cases:

(a) When there is a need to protect a human life, body or property and it is difficult to obtain the user's consent;
(b) When there is a special need to enhance public hygiene or promote the fostering of healthy children, and it is difficult to obtain the user's consent;
(c) When there is a need to cooperate with a central government organization or a local government, or a person entrusted by them performing affairs prescribed by the applicable laws and regulations, and there is a possibility that obtaining the user's consent would interfere with the performance of the said affairs;
(d) When so required under the applicable laws and regulations.

3. The Company will not collect special care-required personal information (as defined in Article 2, Paragraph (3) of the Personal Information Protection Act) without obtaining prior consent of the user, except in cases set forth in each item of Article 17, Paragraph (2) of the Personal Information Protection Act.

3. Third Party Provision

1. The Company may disclose the user's Personal Data to contractors of the Company or to other third parties (excluding third parties in foreign countries; the same shall apply hereinafter in this paragraph), in the following cases:

(a) When the consent of the user is obtained;
(b) When courts, public prosecutors, police,tax offices, bar associations, or any organizations vested with similar authority demand that Personal Information be disclosed;
(c) When such disclosure is made to financial institutions, credit card companies, settlement agents and/or other entities that conduct settlements or act as settlement agents, for the settlement of fees and other monies payable to the Company;
(d) When such disclosure is made to a successor of a business when the business is succeeded due to a merger, business transfer or other similar event;
(e) When it is permitted by the Personal Information Protection Act or any other laws or regulations;
(f) Other cases specified individually in each service of the Company.

2. Even in the case where none of the circumstances in the preceding paragraph applies, the Company may provide the user's Personal Data (excluding special care-required personal information; the same shall apply hereinafter in this paragraph) to third parties (excluding third parties in foreign countries; the same shall apply hereinafter in this paragraph) after giving a notification to the Personal Information Protection Commission within the following scope:

(a) Items of Personal Data to be provided to third parties pursuant to this paragraph
All of the user's Personal Information unless the user specifically requests otherwise

(b) Method of provision to third parties pursuant to this paragraph
Paper, transmission of electronic data, delivery in the form of external recording media, or access to the server

(c) Method of requesting suspension of provision pursuant to this paragraph
If the user requests that the Company suspend the provision to third parties pursuant to this paragraph, the Company will suspend the provision of Personal Data that can be used to identify the actual user to the relevant third parties without delay in accordance with the applicable laws and regulations. 3. In any of the following cases, the Company may provide the user's Personal Data to third parties in foreign countries:

(a) When the user has given prior consent for the Data to be used by third parties in foreign countries;
(b) When Personal Data is provided to a third party in a foreign country that takes measures in accordance with the provisions of Chapter 4, Section 1 of the Personal Information Protection Act with respect to the handling of Personal Data in an appropriate and reasonable manner and whose implementation of such measures is secured in relation to the Company;
(c) When the identification of an individual user is disabled;
(d) When any of the circumstances of 2. (2) (a) through (d) above applies.

4. Joint Use

The Company may jointly use Personal Information according to the following:

1. Scope of joint-users (the following companies which are group companies of the Company) Emb IV Inc, Synastasia Inc., Perception engine Inc., Field Auto Inc., Brain IV Inc., Map IV Inc., Human Detaware Lab, Inc.

2. Purposes of use of the joint-users

(a) To provide various services;
(b) To verify the user's identity associated with the services provided by the Company
(c) For after-sales services, and responding to inquiries and complaints incidental to (a) or (b) above;
(d) To provide Personal Information or Personal Data to third parties in order to achieve the purposes of use above.

3. Items of Personal Information to be used jointly: Name, date of birth, address, telephone number, e-mail address and company name, etc.

5. Implementation of Safety Management Measures

1. The Company will implement necessary and appropriate organizational, human, technical and physical safety management measures to properly manage Personal Information in order to prevent unauthorized access to, and loss, alteration and leakage, etc. of, Personal Information.

2. The Company will enter into a contractor agreement with the contractor that includes a confidentiality clause. The Company will endeavor to properly handle and protect the users' Personal Information, and work to prevent leakage, reprovision/disclosure to third parties, and use outside the scope of the purpose stated in 2. (1) above.

6. Disclosure, Correction, Addition, Deletion, Suspension of Use, Erasing, and Suspension of Provision to Third Parties of Personal Information and Personal Data

2. The Company will, with the aim of preventing leakage of Personal Information and securing accuracy and safety, conduct all necessary investigations without delay, unless special procedures are prescribed by the applicable laws and regulations. If it is confirmed that the request was made by the user itself, the Company will disclose, correct, add, delete, suspend the use of, erase, or suspend the provision to third parties of the users' Personal Data in accordance with the relevant provisions of the laws and regulations.

7. Disclaimer

When using the Company's website, please take care to manage the IDs and passwords that the user has registered with the Company. The Company shall not be liable for any loss or damage caused by the unauthorized use of such IDs and passwords. Please note that the Company may suspend the use of the user's ID and password in the event that the user registers a falsehood or any other person's information, etc.

8. Update of Policy

The Company may change the contents of the Policy from time to time as necessary. We will not inform users on each occasion thereof, so please refer to the latest version posted on the Company's website for the up-to-date details of the Policy.

9. Cookies

1. The Company's website contains pages that use cookies to enable the users to use the website more conveniently when accessing it. Cookies can identify the information devices used by the user's computer. However, unless the user inputs Personal Information, cookies cannot identify the user itself. For information on the collection and processing of data through the use of Google Analytics, please refer to Google's use of data when the users use the sites and apps of our Google partners. The information collected will be managed in accordance with the privacy policies of the Company and Google Inc.

The Company also uses the advertising features of Google Analytics. The functions the Company use are as follows; Remarketing using Google Analytics, Impressions report on the Google Display Network, Customer Distribution Report and Interest Report in Google Analytics.

The third-party distributors including Google Inc. will use cookies, anonymous IDs, and other information about the users visit to the website, the user's interests and the user's location to serve the users the best possible ads.

The user may opt-out of receiving Google's interest-based ads through the advertising settings provided by Google Inc. In addition, the Company and third-party distributors, including Google Inc. may use first party cookies (such as Google Analytics cookies) or other first party IDs and third party cookies (such as DoubleClick cookies) or other third party IDs. The Company uses this information in combination to analyze the attributes and interests of customers who visit our website.

The Company shall not be liable for any loss or damage caused by the use of the Google Analytics service.

Special clauses for shooting image data on public roads.

Special Clauses for Shooting Image Data on Public Roads ("Special Clauses") is to define the special clauses accompanies to the privacy policy of TIER IV (located at the Nagoya University Open Innovation Center, 1-3, Mei-eki 1-CHOME, Nakamura-Ward, Nagoya-City, Aichi Prefecture, 450-6627, Japan, the “Company”), in conducting business related to filming and acquisition of image data on public roads (hereinafter referred to as the "Project" in the Special Clauses) by the Company.

In the event that the Company acquires personal information in the course of conducting the Project, the Company will handle and protect the personal information appropriately as described below.

1. Overview of the Project

As part of the Project, the Company shall install cameras on the outside surface or the top of road transport vehicles (as defined in Article 2, Paragraph 1 of the Road Transport Vehicles Act) managed by the Company or a third party in cooperation with the Company, photograph the public roads while they are in motion, and acquire and analyze the image data of the public roads ("Public Road Image Data"). Although the purpose of this project is not to obtain information that identifies individuals or personal privacy information about the individuals photographed in the Public Road Image Data, there is a possibility that the Public Road Image Data may contain information that identifies individuals on the public road, such as the appearance of an individual or the exterior and nameplate of a residence, etc.

2. The type of personal information to be collected

The appearance of an individual, the appearance of the building and the nameplate with the name of the individual, a privately owned road transport vehicle (including its number plate), and any other information that may identify the individual.

3. The purpose of use of personal information

To acquire and analyze 3D spatial data related to the automated driving system business held by the Company, and to develop and provide automated driving system business

4. The range of persons to be shared

The Company and its group companies as well as business partners in the Project. Individual companies with which the Company partners are limited to those listed separately on the Company's website.

6. Content policy

In order to protect the privacy of individuals with respect to the following content managed and operated by the Company, the Company shall promptly respond to the following requests for information contained in such content (including both information posted by the Company and the users) (1) Content that is the subject of the request: Information obtained by the Company in the Project that contains personal information (2) Possible requests: Blurring or other anonymous processing of an individual's appearance, the license plates of privately owned road transport vehicles, etc.

7. How to make a request

The Company will only accept requests for blurring or deletion of an image upon receipt of an email containing details of the image to be blurred at the following email address.
